Abstract
This ZSE Special Issue is in honour of Joachim Jens Hesse, a scholar whose multi-faceted work may be characterised as an attempt at “crossing border” in several respects. These primarily include fostering interdisciplinary cooperation between law, economics and social sciences, analysing public sector developments in an international and intercultural perspective as well as bridging the “gap” between academia and practical politics. Therefore, the volume deals with a subject that covers these features in an exemplary manner: the interrelationship between nation-state constitutions and their international environments. In this context, ongoing processes of transnationalisation have not only contributed to blurring the formerly clear-cut boundaries between these two domains, but also provoked a growing interest in and demand for comparative, interdisciplinary and applied research on constitutional developments. The present contribution highlights the “cross-border” aspects of Hesse's work, points to some theoretical and analytical challenges of the topic and provides an outline of this Special Issue. Abstract Dieses ZSE-Themenheft erscheint zu Ehren von Joachim Jens Hesse, einem Wissenschaftler, dessen facettenreiches Oeuvre als ein Versuch verstanden werden kann, in mehreren Hinsichten „grenzüberschreitend“ zu wirken. Dazu zählen vor allem die Förderung interdisziplinärer Zusammenarbeit zwischen Rechts-, Wirtschafts- und Sozialwissenschaften, die Analyse des öffentlichen Sektors im internationalen und interkulturellen Vergleich sowie die Überwindung der „Kluft“ zwischen Staatswissenschaften und Staatspraxis. Der vorliegende Band befasst sich mit einem Gegenstand, der die benannten Dimensionen in exemplarischer Weise erfüllt: dem Wechselverhältnis von nationalstaatlichen Verfassungen und ihrer internationalen Umwelt. In diesem Zusammenhang hat die fortschreitende Transnationalisierung nicht nur dazu beigetragen, die ehemals klaren Grenzen zwischen den beiden Bereichen zu verwischen, sondern auch wachsendes Interesse und zunehmenden Bedarf an vergleichenden, interdisziplinären und anwendungsbezogenen Verfassungsanalysen hervorgerufen. Der vorliegende Beitrag geht zunächst auf die „grenzüberschreitenden“ Aspekte in Hesses Werk ein, benennt dann einige theoretische und analytische Herausforderungen der Themenstellung und gibt schließlich einen Überblick über den Aufbau des Sonderhefts.

Abstract
Das Geschichtsbild eines „deutschen Sonderwegs“ ist stark von Erfahrungen mit dem Kaiserreich von 1871 geprägt, dessen institutionelle Ordnung vor allem darauf zielte, den Weg in eine parlamentarische Demokratie zu blockieren. Einer der frühesten und radikalsten Kritiker dieses Verfassungsrahmens war der linksliberale Politiker und Jurist Hugo Preuß. Seine Fundamentalkritik, die auf einem Vergleich mit der englischen, französischen und nordamerikanischen Geschichte beruhte, machte ihn zu einem Außenseiter, dessen Wirkung auch innerhalb des Liberalismus begrenzt blieb. Nach dem Ende des Kaiserreiches gewann er jedoch an politischem Einfluss und wirkte maßgeblich an der Erarbeitung der Weimarer Verfassung (1919) und der preußischen Landesverfassung (1920) mit. Der vorliegende Beitrag befasst sich mit dem „politischen Menschen“ Hugo Preuß während der monarchischen Zeit, als er die deutsche Geschichte kritisch Revue passieren ließ, um zu ergründen, warum Deutschland anders sei als andere westliche Staaten und Gesellschaften. Abstract The common historical view of a “German Sonderweg” was strongly influenced by experiences with the Empire of 1871 whose institutional order mainly aimed to obstruct the path to parliamentary democracy. One of the earliest and most radical critics of this constitutional framework was the leftist-liberal politician and lawyer Hugo Preuß. His fundamental criticism based on a comparison with the English, French and North American history turned him into an outsider whose influence remained limited even within the liberalist stream. However, in the aftermath of the Empire he gained in political influence and decisively contributed to the elaboration of the Weimar Constitution (1919) as well as the Prussian Constitution (1920). The present contribution deals with the “political man” Hugo Preuß during the monarchic period, when he critically looked back at German history in order to explore the reasons why Germany was different from other Western states and societies.

Abstract
Der Beitrag analysiert die Tätigkeit von Ludwig Rieß (1861–1928), dem ersten europäischen Fachhistoriker, der in Japan von 1887–1902 moderne europäische Geschichtswissenschaft lehrte, und versucht, die Bedeutung seiner Forschung und Lehre für die Entwicklung der Geschichtsauffassung in Japan zu würdigen. Rieß, ein Schüler von Hans Delbrück in Berlin, war stark geprägt von dem universalistischen Geschichtskonzept von Leopold von Ranke. Angeregt von dem Aufstieg Japans nach dem Japanisch-Chinesischen Krieg widmete er sich der Forschung der internationalen Beziehungen Japans als einem Teil der Weltgeschichte und sah die „universale Bedeutung“ der japanischen Geschichte in der historisch bedingten Fähigkeit, durch die Herausbildung eines modernen Nationalstaats an dem „Gleichgewicht der Mächte“ in Ostasien teilgenommen zu haben. Sein Geschichtsbild war nicht nur eurozentrisch, sondern auch in Deutschland überholt. Es ermöglichte jedoch, die Geschichte und den Staat Japans unter einem universalen und komparatistischen Blickwinkel zu betrachten. Abstract This article analyses the historical works of Ludwig Rieß (1861–1928) and their meaning for the modern Japanese historiography. Rieß was the first professional historian from Europe who taught at the Imperial University of Tokyo from 1887 to 1902 and introduced the modern European Historical Studies in Japan. A disciple of Hans Delbrück in Berlin, he was strongly influenced by Leopold von Ranke's universalistic concept of World History. Impressed by the rise of Japan after the Sino-Japanese War, he studied the history of Japan's international relations and saw the “universal meaning” of Japanese history in her historically acquired ability to build a nation-state rapidly and to take part in the “concert of power” in East-Asia. His concept was not only Eurocentric, but also outmoded in Germany. However, it enabled to put history and state of Japan in a universal and comparative perspective.

Abstract
Die Streitkräfte gehören zu den verfassungsmäßig bestehenden Machtmitteln des Staates. Ihre Verwendung ist grundsätzlich nicht auf Verteidigung gegen einen äußeren Feind begrenzt, zumal die Trennung von „innen“ und „außen“ angesichts des organisierten internationalen Terrorismus an Bedeutung verloren hat. Ein Einsatz der Streitkräfte auf dem eigenen Staatsgebiet sollte jedoch auf verfassungsrechtlich enumerierte Fälle beschränkt werden, in denen die innere Sicherheit im Rahmen der polizeilichen Gefahrenabwehr oder ohne den Einsatz militärischer Fähigkeiten nicht gewährleistet werden kann. Angesichts der aktuellen politischen Debatte in der Bundesrepublik Deutschland untersucht der vorliegende Beitrag den Auftrag, den das Grundgesetz der Bundeswehr zuweist, und unterzieht entsprechende Initiativen und Vorschläge zur Verfassungsänderung einer kritischen Prüfung. Abstract Armed forces belong to the constitutional instruments of state power. Their utilisation is generally not limited to defending one's country against an external enemy, particularly as the separation between “domestic” and “foreign” policies has become less important in view of organised international terrorism. However, missions of the armed forces on the state's own territory ought to be constrained to constitutionally enumerated cases, in which homeland security can neither be guaranteed by police danger prevention nor without deployment of military abilities. In light of the current political debate in Germany the present contribution analyses the mandate the Basic Law assigns to the Federal Armed Forces and critically reviews relevant initiatives and proposals for constitutional reform.

Abstract
The American constitution, founded in 1787, anticipates a balance of power between its branches of government and between federal and state authority. Plausibly though, the enumerated powers of the legislative branch suggest that the Congress may well have been the expected source of governing authority with much of the balancing occurring as a result of the different forms of representation and term lengths across its two chambers. Practice, however, has made the federal government more dominant over the years and, along with that, it also has expanded the prerogatives of the presidency. Crisis and war similarly expand the powers of each, though not without some limitations. Current doctrines of presidential assertion, vigorously pushed by the Bush-Cheney administration, have taken presidential authority far beyond the basic governing law of the United States, though usually not without the assent of other institutional actors in the system. This article explores why that has happened and the potential threats that it raises for a political system whose institutions were meant to counter ambition with ambition. Abstract Die US-amerikanische Verfassung von 1787 geht von einer Machtbalance sowohl zwischen den Regierungsinstitutionen als auch zwischen Bundes- und Staatenebene aus. Allerdings legen die dort benannten Kompetenzen der Legislative nahe, dass der Kongress die eigentliche Quelle der gesamtstaatlichen Autorität bildet, wobei sich die Machtbalance im Wesentlichen aus den unterschiedlichen Repräsentationsformen und Wahlperioden der beiden Kammern ergibt. In der Staatspraxis jedoch hat die Bundesregierung im Laufe der Jahre eine immer dominantere Position eingenommen. Insbesondere in Krisen- und Kriegszeiten wurden zugleich die Prärogativen der jeweiligen Präsidenten beträchtlich erweitert – allerdings nicht unbegrenzt. Aktuelle Doktrinen präsidentieller Stärke, die von der Regierung Bush-Cheney nachdrücklich vertreten werden, haben die Autorität des Präsidenten weit über die verfassungsmäßigen Grenzen ausgedehnt, was jedoch meist nicht ohne Zustimmung anderer institutioneller Akteure erfolgte. Der vorliegende Beitrag untersucht die Gründe dieser Entwicklung sowie die potentiellen Gefährdungen, die sich daraus für ein gewaltenteilig organisiertes Regierungssystem ergeben.

Abstract
La France a un régime qui, en profondeur, est beaucoup moins original qu'elle-même ne le croit. Mais il alimente un débat et des remises en cause permanents, auxquels l'élection de Nicolas Sarkozy a donné un tour nouveau, principalement à raison de l'activisme personnel du nouveau Président, qui rend d'autant plus nécessaires la modernisation et le rééquilibrage des institutions. Un Comité a été formé à cette fin, dont les missions premières consisteront à clarifier les relations entre le chef de l'Etat et le Premier ministre, à revaloriser de façon substantielle le rôle du Parlement, enfin à parachever l'Etat de droit par la réforme appropriée de la justice constitutionnelle. Si ces objectifs sont atteints, il ne restera pas plus qu'à espérer que les joueurs se montreront à la hauteur de la règle du jeu qui sera mise à leur disposition. Abstract Frankreich besitzt ein Regierungssystem, das im Grunde genommen wesentlich weniger außergewöhnlich ist, als man dort meint. Allerdings verbindet sich damit eine ständig wiederkehrende Reformdebatte, die nach der Wahl von Nicolas Sarkozy eine neue Wendung genommen hat. Der wichtigste Grund dafür liegt im persönlichen Auftreten des neuen Präsidenten, das die Modernisierung und Ausbalancierung der politischen Institutionen umso dringlicher erscheinen lässt. Zu diesem Zweck wurde ein Gremium eingesetzt, dessen Hauptaufgaben darin bestehen, die Beziehungen zwischen Staatschef und Ministerpräsident klar zu definieren, die Stellung des Parlaments substanziell aufzuwerten sowie den Rechtsstaat durch eine angemessene Reform der Verfassungsgerichtsbarkeit zu vervollständigen. Sollten diese Ziele erreicht werden, bleibt nur zu hoffen, dass die Akteure sich auch den Spielregeln gewachsen zeigen, die ihnen vorgegeben sind.

Abstract
This article attempts to apply a constitutional political economy approach to a subject that has rarely if ever been analysed from this perspective. While the systemic change following the collapse of the Soviet Empire has provided social scientists with the opportunity to refer to constructivist insights on the holistic transformation of the social order, the application of related theories has been meagre. The following analysis presents an outline of how constitutional development influenced economic change in one of the new EU member states during the past two decades, and formulates suggestions on how insights from the above line of thought might be operationalised to improve the given institutions and policies. Abstract Der vorliegende Artikel sucht einen konstitutionenökonomischen Ansatz auf einen Gegenstand anzuwenden, der nur selten – wenn überhaupt – aus einer solchen Perspektive untersucht wurde. Zwar bot der Systemwechsel, der auf den Zusammenbruch des sowjetischen Imperiums folgte, Sozialwissenschaftlern eine Gelegenheit, auf konstruktivistische Erkenntnisse über eine gesamthafte Transformation der Gesellschaftsordnung zurückzugreifen; die Anwendung entsprechender Theorien blieb jedoch eher dürftig. Die folgende Analyse untersucht die Frage, wie die Verfassungsentwicklung in einem der neuen EU-Mitgliedstaaten den wirtschaftlichen Wandel während der vergangenen zwei Jahrzehnte beeinflusst hat. Dabei werden einige Vorschläge formuliert, inwiefern Einsichten aus der benannten Denkschule operationalisiert werden könnten, um die bestehenden Institutionen und Politiken zu optimieren.

Abstract
Korea offers an interesting case on the institutionalisation of representative democracy in a country that started off as a pure administrative state. Developments in the Korean Parliament have not been smooth at all, this body having undergone several dramatic changes in major functions, political composition and administrative infrastructure since the establishment of the First Republic in 1948. In the period from the First to the Second Republic, the National Assembly played quite a significant role. During the rule of the military junta and the years from the Fourth to the Fifth Republic, the Assembly was almost completely inactive, whereas its role has continued to improve since the establishment of the Sixth Republic. The fact that Korea's parliamentary democracy withered during the 1970s and 1980s, a period of rapid industrialisation, confirms the thesis of “bureaucratic authoritarianism”. In a longer-term perspective, however, the representative-democratic system, which has remained active after the country's industrialisation period, supports the “modernisation thesis”. Although the National Assembly's increasing reinvigoration has contributed to weakening the traditional strong state, there is currently no indication that a constitutional political or legislative state in the Western sense will be realised in the near future. Abstract Korea bildet einen interessanten Fall von Institutionalisierung der repräsentativen Demokratie in einem Land, das als reiner „Verwaltungsstaat“ begann. Die Entwicklung des koreanischen Parlaments verlief alles andere als reibungslos; seine Funktionen, politische Zusammensetzung und administrative Infrastruktur erfuhren mehrfach dramatische Veränderungen seit Begründung der Ersten Republik 1948. Von der Ersten bis zur Zweiten Republik spielte die Nationalversammlung eine relativ bedeutsame Rolle. Während der Militärherrschaft und in der Zeit der Vierten und Fünften Republik war die Versammlung nahezu vollständig inaktiv, während sich ihre Rolle seit Begründung der Sechsten Republik kontinuierlich verbesserte. Die Tatsache, dass Koreas parlamentarische Demokratie während der rasanten Industrialisierungsphase in den 1970er und 1980er Jahren verkümmerte, bestätigt die These vom „bürokratischen Autoritarismus“. In längerfristiger Perspektive blieb jedoch das repräsentativdemokratische System auch nach der Industrialisierungsphase bestehen, was wiederum die „Modernisierungsthese“ stützt. Obwohl der zunehmende Bedeutungsgewinn der Nationalversammlung zur Schwächung des traditionellen „starken Staats“ beigetragen hat, gibt es gegenwärtig keine Anzeichen, dass in absehbarer Zukunft ein konstitutioneller „Gesetzgebungsstaat“ nach westlichem Modell verwirklicht wird.

Abstract
In the People's Republic of China (PRC), dynamic policy evolution and related socioeconomic changes strikingly contrast with the absence of any democratic transition similar to those most communist countries have undergone during the last two decades. Nevertheless, policy reforms of the Chinese government entail a number of important administrative and legal developments, among them a series of amendments to the Constitution. This contribution analyses whether and how constitutional reforms are to be interpreted as part of the PRC's modernisation process. It is shown that the constitutional changes so far have not departed from a traditional communist approach but have been used to legitimise fundamental policy changes initiated by the Chinese Communist Party. At the same time, however, this accommodation of the fundamental law triggered a genuine constitutionalisation process that has been subject to severe limitations, while also signalling important changes in political culture and imposing significant tensions on the whole political system. Therefore, recent constitutional developments in China go far beyond the mere window-dressing that is frequently associated with legal practices in communist regimes. Abstract In der Volksrepublik China kontrastiert die dynamische Entwicklung der Staatstätigkeit und ein entsprechender sozioökonomischer Wandel deutlich mit dem Ausbleiben einer demokratischen Transition, wie sie die meisten kommunistischen Staaten während der vergangenen beiden Jahrzehnte erlebt haben. Gleichwohl zieht die Reformpolitik der chinesischen Regierung einige rechtliche und administrative Entwicklungen nach sich, wozu auch eine Reihe von Verfassungsänderungen zählen. Der vorliegende Beitrag untersucht, ob und inwiefern diese Verfassungsreformen als Teil des chinesischen Modernisierungsprozesses zu interpretieren sind. Es wird gezeigt, dass die bisherigen Verfassungsänderungen nicht von dem traditionellen kommunistischen Ansatz abwichen, sondern dazu dienten, die substanziellen Veränderungen der Staatstätigkeit zu legitimieren, die von der Chinesischen Kommunistischen Partei initiiert wurden. Zugleich jedoch hat diese Anpassung des Grundgesetzes einen genuinen Konstitutionalisierungsprozess ausgelöst, der zwar deutlich begrenzt blieb, aber bedeutsame Veränderungen in der politischen Kultur widerspiegelt und erhebliche Spannungen im gesamten politischen System bewirkt. Von daher gehen die neueren Verfassungsentwicklungen in China eindeutig über rein symbolische Maßnahmen hinaus, die häufig mit der Rechtspraxis in kommunistischen Regimen assoziiert werden.

Abstract
Bundesstaaten benötigen eine Verfassung, die die Gewaltenteilung und Beziehungen zwischen Gebietskörperschaften und ihren Institutionen stabilisiert. Die durch gesellschaftliche und politische Prozesse bedingte Dynamik föderativer Ordnungen macht aber immer wieder Verfassungsreformen notwendig. Die Wahrscheinlichkeit, dass diese scheitern, ist sehr hoch. Dies wird für den deutschen und den kanadischen Bundesstaat dargestellt. Der Vergleich der beiden Fälle liefert Hinweise auf Auswege aus dem Dilemma. Zu vermuten ist, dass Verfassungsreformen, an denen neben Regierungen auch Vertreter gesellschaftlicher Interessengruppen beteiligt werden, unabhängig vom Ausgang der Reform die Legitimitätsbasis für einen evolutionären Wandel der Verfassung schaffen und ihm die Richtung weisen können. Abstract Federal states need a constitution to stabilise the balance of power and the relations between constituent units and their institutions. Due to the dynamics driven by economic, social and political processes, federal constitutions have to be revised on a regular basis. However, constitutional reforms are likely to fail, in one way or another, as it is illustrated by case studies on Germany and Canada. Beyond insights into the causes of failure, a comparative view of these cases points out how federal states can escape their constitutional dilemma. Presumably a reform process which is open for social interest groups can create the basis for an evolutionary change of the constitution both with regard to substance and legitimacy.

Abstract
While the concept of the cooperative state is generally connected to German federalism, it may also be used to study intergovernmental relations in non-federal systems of governance. As such it reveals how actual relative subsystem autonomy within a unitary state might be as large – or as small – as within a federal structure. On the basis of a “constitutional” analysis of the intergovernmental system, the principles of self-government and collaborative decentralisation in the Dutch context are outlined. Next, a comparative framework depicting institutional contexts of intergovernmental systems is developed. This framework directs attention to the horizontal or vertical nature of intergovernmental relations, the degree of administrative and political interwovenness, and the forms of intergovernmental management applied. Following, a comparative overview of institutional developments within five unitary state systems – England, Denmark, Sweden, France and the Netherlands – is presented. The concept of the cooperative state is used to analyse the quest for local government autonomy and assess ongoing developments in these unitary states. The analysis suggests that in the debate on local government autonomy, one should take into account the different institutional contexts of local governments. Collaborative decentralisation is advocated to be a structural way to secure the role of local government in the emerging European systems of multi-level governance. Abstract Obwohl das Konzept des „kooperativen Staates“ im Allgemeinen mit dem deutschen Föderalismus verbunden wird, kann man es auch dazu benutzen, die intergouvernementalen Beziehungen in nicht-föderalen Regierungssystemen zu untersuchen. Dabei zeigt sich, dass die relative Autonomie der Subsysteme innerhalb eines Einheitsstaates so groß – oder so gering – sein kann wie in einem Bundesstaat. Auf Basis einer „Verfassungsanalyse“ des intergouvernementalen Beziehungssystems arbeitet der vorliegende Beitrag zunächst die Prinzipien der Selbstverwaltung und kooperativen Dezentralisierung im niederländischen Kontext heraus. Daraufhin wird ein vergleichender Analyseansatz vorgestellt, der die institutionellen Kontexte intergouvernementaler Systeme umfasst. Hierbei geht es insbesondere um die horizontale und vertikale Dimension der intergouvernementalen Beziehungen, das Ausmaß der administrativen und politischen Verflechtung sowie die Formen des intergouvernementalen Managements. Anschließend kommt es zu einem Vergleich der institutionellen Entwicklung in fünf Einheitsstaaten (England, Dänemark, Schweden, Frankreich und den Niederlanden). Das Konzept des „kooperatives Staates“ dient in diesem Zusammenhang dazu, den Bedarf an lokaler Autonomie zu untersuchen und die aktuellen Entwicklungstrends in den einzelnen Fällen einzuschätzen. Die Analyse legt nahe, dass man bei der Debatte über lokale Autonomie die unterschiedlichen institutionellen Kontexte kommunaler Gebietskörperschaften stärker berücksichtigen sollte. Kooperative Dezentralisierung erscheint demnach als strukturelle Handlungsoption, um die Stellung der lokalen Ebene innerhalb des dynamischen europäischen Mehrebenensystems abzusichern.

Abstract
The long-term impact on Westminster systems of generations of administrative reform is a central question for evaluating the substantial investment in designing and managing change. Australia, Canada, New Zealand and the United Kingdom were among the first reformers and have since been among the most active through their experiments with new public management. The article discusses reform outcomes in terms of durable and transient features of public management. The complexities of managing and reforming the modern state and the internal contradictions in comprehensive reform programmes have provided much of the momentum for change. This has led towards mainstreaming the systems as political leaders seek an effective range of tools for governance. Abstract Die langfristigen Auswirkungen, die unterschiedliche Generationen von Verwaltungsreformen in Westminstersystemen hatten, sind eine Schlüsselfrage, um den materiellen Aufwand für die Planung und Durchführung von Reformen zu beurteilen. Australien, Kanada, Neuseeland und das Vereinigte Königreich zählten zu den ersten Reformstaaten und waren seitdem höchst aktiv beim Experimentieren mit New Public Management-Ansätzen. Der vorliegende Beitrag diskutiert die dort erkennbaren Reformergebnisse mit Blick auf dauerhafte und eher situative Charakteristika von Public Management. Sowohl die komplexen Probleme, die bei der Verwaltung und Reform des modernen Staates auftreten, als auch die internen Widersprüche umfassender Reformprogramme haben im Wesentlichen den Wandel angestoßen. Dies wiederum hat zu einer Modernisierung der Verwaltungssysteme geführt, zumal die politische Führung ein effektives Regierungsinstrumentarium benötigt.

Abstract
A politically impartial, merit-based and professional civil service is an important feature of a living constitution in liberal democracies. Although this classical model has survived as key benchmark for the development of civil service systems, numerous states in diverse regional contexts remain stubbornly outside the confines of this value framework. The present article reviews two different cases in which the model has failed to make a breakthrough: the continued stalemate on most of the African continent as well as the more recent reversal of trends towards establishing independent civil service systems in new EU member states. In doing so, the analysis provides insight into why the classical model, although still alive and well in OECD states, has not made as many universal inroads as most observers might have expected and whether this is a temporary phenomenon or one that gives rise to the need to think about alternative models for the organisation of civil service systems. Abstract Ein politisch neutraler, leistungsbezogener und professioneller öffentlicher Dienst ist ein wichtiges Kennzeichen einer „lebenden Verfassung“ in liberalen Demokratien. Obwohl dieses „klassische Modell“ unverändert als Schlüsselkriterium für die Entwicklung eines öffentlichen Dienstes gilt, verbleiben zahlreiche Staaten in verschiedenen Weltregionen außerhalb dieses Werterahmens. Der vorliegende Artikel untersucht zwei unterschiedliche Fälle, in denen das Modell bislang nicht erfolgreich umgesetzt werden konnte: die andauernde Stagnation in weiten Teilen Afrikas sowie die jüngste Trendumkehr in den neuen EU-Mitgliedstaaten bei dem Versuch, einen unabhängigen öffentlichen Dienst einzurichten. Die Analyse zeigt auf, warum das klassische Modell, das in den OECD-Staaten gut funktioniert, nicht jenen globalen Siegeszug angetreten hat, den die meisten Beobachter erwartet hatten; zudem wird erörtert, ob diese Entwicklung ein Übergangsphänomen darstellt oder Anlass dazu gibt, über alternative Organisationsmodelle nachzudenken.

Abstract
Im Oktober 2007 hat der Europäische Rat von Lissabon einer Reform des Europäischen Vertragswerks zugestimmt. Unterstellt, der Ratifizierungsprozess in den 27 Mitgliedstaaten verläuft erfolgreich, wird die EU damit drei gleichrangige Grundverträge haben: den Vertrag über die Europäische Union, den Vertrag über die Arbeitsweise der Europäischen Union sowie die Grundrechtecharta. Obwohl sich darin zahlreiche Normen aus dem Verfassungsentwurf wiederfinden, sind die Folgen für die rechtssystematische Interpretation erheblich. Die Zurückweisung des Verfassungsvertrags war eine politische Entscheidung, dass die EU keine Verfassung im herkömmlichen Sinn erhalten soll. Da aber Gemeinschaftsrecht mitgliedstaatlichen Verfassungen vorgeht, sind diese längst zu Bereichsverfassungen geworden.Wenn die Europäische Union keine Verfassung hat und die mitgliedstaatlichen Verfassungen nur Bereiche abdecken, so sind weite Bereiche des Rechts verfassungslos. Ein möglicher Ausweg bestünde in einer „Europäisierung“ des Verfassungsbegriffs: Demnach ist Verfassung ist nicht mehr Staatsgrundlegung, sondern Entwicklungsordnung. Dieser Begriff kann aber nur Bestand haben, wenn die Verfassungsverneinung aus der Debatte um den Verfassungsvertrag ignoriert wird. Abstract In October 2007, the Lisbon European Council approved a Reform of the European Treaties. Provided the ratification process has then successfully been completed in all 27 Member States, the EU will have three coequal Basic Treaties: the Treaty on the European Union, the Treaty on the Functioning of the European Union and the Charter of Fundamental Rights. Although this framework includes numerous norms of the Draft Constitutional Treaty, the consequences for systematic legal interpretation will be immense. It was a political decision to reject the Constitutional Treaty, since the EU should not have a constitution in the traditional sense. As Community Law precedes Member State constitutions, the latter have long ago become “divisional constitutions”. If the European Union did not have a constitution and Member State constitutions only cover specific fields, large parts of law would not have any constitutional basis at all. A potential way out might consist in “Europeanising” the concept of constitution: It would then refer to an evolving order rather than to a fundament of state. However, this concept can only endure, if the negation of the constitution that came out of the debate on the Constitutional Treaty is ignored.

Abstract
Regional organisations have been mushrooming since the turn of the century. Regional organisation is attractive because it offers flexible responses to the challenges of globalisation. However, the uncertainty with respect to regional organisation is endemic since governments tend to postpone or renege on ambitious plans for far-reaching regionalisation, not knowing what its implications would be. When a regional organisation engages in a common market project, then the question of the ratio of benefits against costs becomes so highly relevant that constitutional decision-making is called for. A new structure for economic regulation must be designed and enforced, the consequences of which spill over into other state regulations. A regional trading block must devise and run a minimum of common institutions in order to qualify as an organisation. In a maximum approach, a regional organisation takes over public competences from the participating nation-states. Regionalism is on its way to becoming a new interdisciplinary field in the social and economic sciences. This article stresses real agency as opposed to regional blocks that may be created for the mere purpose of political symbolism. Abstract Seit der Jahrhundertwende hat sich die Zahl von Regionalorganisationen deutlich vermehrt. Die Bildung regionaler Organisationen erscheint attraktiv, weil dies flexible Antworten auf die Herausforderungen der Globalisierung ermöglicht. Allerdings verbindet sich damit ein gewisses Maß an Unsicherheit, weil Regierungen dazu neigen, ehrgeizige Pläne für eine weit reichende Regionalisierung zu verschieben oder ganz fallen zu lassen, da sie deren Auswirkungen kaum einzuschätzen vermögen. Wenn eine Regionalorganisation einen Gemeinsamen Markt errichten will, wird das Kosten-Nutzen-Verhältnis so bedeutsam, dass verfassungspolitische Entscheidungen gefordert sind. Denn es müssen neue regionale Strukturen für ökonomische Regulierung geschaffen und umgesetzt werden, die wiederum Konsequenzen für andere Bereiche staatlicher Regulierung haben. Um als Organisation bezeichnet zu werden, muss ein regionaler Handelsblock ein bestimmtes Minimum an gemeinsamen Institutionen ausweisen. Im weitestgehenden Fall übernimmt eine Regionalorganisation bestimmte öffentliche Aufgaben von den beteiligten Nationalstaaten. Regionalismus wird immer mehr zu einem interdisziplinären Feld in den Sozial- und Wirtschaftswissenschaften. Der vorliegende Beitrag hebt die reale Funktionsweise regionaler Blöcke hervor, zumal diese auch nur zum Zweck symbolischer Politik geschaffen werden können.

Abstract
Constitutional principles have been developed as a part of national legal orders. They were formulated in a historical situation where the nation-state created the framework for an isolated and sovereign legal order in which only the interests of the national community were taken into account. The growing internationalisation has changed this situation radically. The present contribution argues that national constitutional law continues to be of crucial significance in today's world, but at the same time has to “open up” to the international level. National courts will play a key role by judging the adherence to constitutional principles in transnational co-operation. They cannot fulfil this role properly when they rigidly adhere to their domestic legal system. They should also refer to common constitutional principles to be developed across borders. Abstract Verfassungsprinzipien sind als Teil nationalstaatlicher Rechtsordnungen entstanden. Sie wurden in einer historischen Situation formuliert, in der der Nationalstaat den Rahmen für eine abgeschlossene und souveräne Rechtsordnung bildete, die nur auf die Interessen der nationalen Gemeinschaft ausgerichtet war. Die fortschreitende Internationalisierung hat diese Ausgangssituation nachhaltig verändert. Der vorliegende Beitrag argumentiert, dass nationales Verfassungsrecht auch in der heutigen Welt höchst bedeutsam bleibt, sich zugleich aber gegenüber der internationalen Ebene „öffnen“ muss. Bei der Beurteilung, ob Verfassungsprinzipien bei grenzüberschreitender Kooperation eingehalten werden, kommt nationalen Gerichten eine Schlüsselrolle zu. Dabei können sie sich allerdings nicht ausschließlich an ihre je eigenen Rechtssysteme halten, sondern sollten auch auf gemeinsame Verfassungsprinzipien Bezug nehmen, die grenzüberschreitend zu entwickeln sind.

Abstract
I. Re-introducing Constitutions As the end of an age of managerialism seems to be approaching, it is refreshing to reflect once again on the fundamentals of governance in the public sector. The contributions in this volume represent two ways of understanding and conducting constitutional analysis. Both merit more attention given the operational and even the managerial challenges facing modern government in an age of internationalisation. On the one hand, we have the analysis of constitutions, which can be narrowly defined as the “basic” or “higher” legal framework that forms the source and fundament of public legislation and political action. It can also be used more broadly in the public choice meaning of the “rules of the game”. On the other hand, we have constitutional analysis as an analytical approach to the study of government structures, policy and management. These are then explored from the viewpoint of underlying institutional patterns and actor configurations that are aimed at securing the balance, adaptation, resilience and future development of the economic, social, political or administrative systems under consideration.
